End of Land Registry Fee Exemption For Registering Certain Overriding Interests

• Manorial rights.
• Crown rents.
• Non-statutory rights for embankments or sea or river walls.
• Rights to payment in lieu of tithe (corn rents).
• Chancel repair liability.

Until midnight on 12 October 2013, anyone entitled to the benefit of one of these interests may apply to lodge a caution against first registration of the land affected (in respect of unregistered land) or to enter a notice on the register (in respect of registered land) without payment of a charge (section 117(2), Land Registration Act 2002 (LRA 2002) and, for chancel repair liability, paragraph 15, Schedule 4, Land Registration Fee Order 2012). The Land Registry has announced that the last date for lodgement without payment of a charge of any section 117 application at the Land Registry is Friday 11 October 2013. ‘
